TERMS & CONDITIONS

In these Terms & Conditions the following definitions apply:

 

Definitions

  • Class (Drop-in) –  A class allows you to book and drop into a single class on a first come, first serve basis and to purchase that single class at the standard price.

  • Course (Block) –  A course allows you to book a block of classes held on a specific week day,  reserving your place and purchasing each class at a reduced price.

  • Class Package –  A class package includes a number of sessions available to purchase up front at the standard price that may then be used to book one or more classes as desired up to the limit of the package value. A five class package is valid for three months & a ten class package is valid for six months.

  • Company –  Black Cat Yoga.

  • Client – A person that has booked and/or purchased a Class, Course or Class Package from the Company.

  • Mixed Ability –  In these classes Clients will have varying levels of experience of Yoga and Pilates, from Beginners to Advanced.  This means that the Company will offer a range of exercises for differing levels of experience and fitness levels. These classes are recommended for those Clients who have no injuries and are physically mobile and generally well in health. 

  • Beginners – In these classes Clients will all be of a similar level, with some or no experience of Yoga and Pilates.  Exercises will be limited to Beginner & Improver exercises. This means there are fewer exercise options  and the class will not progress onto more intermediate and advanced exercises. Some Clients may be returning after sickness or injury (with approval from your Physio, Doctor or Consultant).  Despite this being a Beginners class, it could still feel challenging dependant on the Clients level of mobility or fitness level.

  • One to One Class – A one to one class is a private session tailored to the Clients individual abilities and/or injuries.

  • Group Class – A group class is a group session that is aimed at Clients suited to Mixed Ability or Beginner levels.

Payment & Refunds

  • All payments are non-refundable or transferable for any reason, including, but not limited to holidays, injuries [old & new], illness, family illness, travel delays & work issues. If in the rare instance a refund is made a 20% administration fee will be charged.

Booking

  • All Courses & Classes must be paid for at the time of booking online via the booking system. Courses, Classes can be booked in advance. 

  • The option to purchases a Course of Classes will be removed from the website one week prior the new term commencing & only the individual Classes and  Class Packages will be available to book & purchase at the higher rate.

  • Classes can be booked up to 30 minutes prior to the Class start time.

  • Class Packages can be purchased at any time and can be used when you like within the valid time period and prior to the expiration date.

  • Class Packages cannot be extended beyond the expiration date. If there is credit remaining on a Class package after the expiration date, the credit will also expire.

  • Classes are non-transferable.

Injuries & Operations

  • If you are returning after an injury or operation the Client must have agreement from a Doctor or Consultant that it is safe to do so.  By attending a group Class the Client understands that this session has not been tailored to them, their individual needs, their specific injury or illness. Therefore some of the movements and postures may not be suitable. The Client is responsible for following the advice they have received from their Consultant/physio therapist.

  • If the Client require something tailored to their issue or injury then this can only be done through a One to One Class.

Fitness & Health

  • The Client must be able to get up and down from the floor (unaided) and be able to weight bear on hands and knees for some duration of time.  While modifications can be given at times,  the Client accepts that group Classes requires this type of movement.

  • Clients are advised not to undertake strenuous physical activities (some Clients find Yoga and Pilates strenuous, dependant on their overall health and fitness) without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse access if, in its absolute discretion, if it considers that the health of the Client concerned may be endangered by attending the Class.

  • Clients must notify the Company of any circumstances affecting their health which may be exacerbated through practice, & that they fully accept they are choosing to participate in Group Classes.

  • Clients must notify the Company of any changes to their health and wellbeing.

  • The Company will not accept new pregnant Clients. If you have been practicing with the Company prior to your pregnancy you may continue until the stage you feel it is no longer suitable or the Company deems that it is no longer appropriate for the Client to continue.

  • Clients with specific requirements are asked to arrange a One to One.

Retreats & Workshops

  • Retreats & Workshops can be cancelled one full calendar week before the retreat or workshop start time, less the deposit. The remainder of the amount paid for the workshop or event will then be credited to the clients account to be used for further services.

Consent

  • Classes and Courses may start at a beginner level and may progress onto more advanced levels dependent on the type of Class you are attending.   This means that some of the exercises may not be suitable for you, especially if you are attending a Mixed Ability Class or attending a Class because of the suitability of the time and day rather than your specific ability.

  • The Client recognises that services may require physical exertion, which may be strenuous and could result in physical injury, and you are fully aware of the risks involved.

  • The Client understands that it is their responsibility to` consult with a Doctor or Consultant prior to attending Classes.

  • When attending a Class or Course the Client must work within own ability, fitness level and be mindful of how they are feeling on the day itself.  The Client may stop the exercise session, or rest at any stage because of fatigue or strain.  The Client can ask for modifications.

  • The Company accepts no liability for injury of Clients.  The Client agrees that they have read the above release waiver of liability and fully understand its contents. Voluntarily agreeing to its contents and to the terms and conditions stated above.Top of Form
